Refund Policy

How ElmMac handles refund requests for custom website, mobile app, software development and digital service engagements.

At ElmMac Pty Ltd we are committed to delivering professional website development, mobile application development, software development, digital solutions and related technology services. Because of the custom nature of our work, resources, time and expertise are allocated specifically to each client's project upon engagement. Please read this Refund Policy carefully before purchasing any of our services.

1. General Policy

Most services provided by ElmMac Pty Ltd are custom, project-based, and involve significant planning, design, development, consultation and technical work. As such, payments made for services are generally non-refundable once work has commenced. Refund requests are evaluated on a case-by-case basis and subject to the terms outlined below.

2. Deposits and Initial Payments

Any deposit, upfront payment, initiation fee, booking fee or milestone payment made to secure a project is non-refundable once:

  • Project planning has commenced;
  • Requirements gathering has started;
  • Research, consultation, design or development work has begun; or
  • Resources have been assigned to the project.

These payments compensate ElmMac Pty Ltd for time, expertise, administrative costs and project allocation.

3. Refund Eligibility

A client may qualify for a partial refund only under the following circumstances.

Before project commencement

A refund may be considered if:

  • The client submits a written cancellation request before any work has commenced; and
  • No consultation, planning, design, development or project setup activities have been performed.

Approved refunds may be subject to administrative, transaction and processing fees.

Failure to deliver

A refund may be considered if:

  • ElmMac Pty Ltd is unable to commence or complete the project due solely to circumstances within its control; and
  • No mutually acceptable alternative solution can be reached.

4. Non-Refundable Situations

Refunds will not be issued in the following circumstances.

Change of mind

  • The client no longer wants the service;
  • The client decides not to proceed with the project after work has begun.

Delays caused by the client

  • Failure to provide required content, images, documents or credentials;
  • Failure to respond to communications within reasonable timeframes;
  • Repeated changes to project requirements.

Completed work

  • Any completed milestone, phase, deliverable, consultation, design work, development work or software component.

Third-party costs

Refunds do not apply to:

  • Domain registrations;
  • Web hosting services;
  • SSL certificates;
  • Paid software licences;
  • Premium themes or plugins;
  • API subscriptions;
  • Cloud services;
  • App store registration fees;
  • Advertising expenses; or
  • Any other third-party products or services purchased on behalf of the client.

Custom development

Custom-built websites, mobile applications, software systems, integrations, databases, APIs and automation systems are non-refundable once development has commenced.

5. Milestone-Based Projects

Where a project is divided into milestones:

  • Payments already made for completed milestones are non-refundable;
  • Any remaining unpaid milestones may be cancelled by mutual agreement;
  • Deliverables completed and paid for remain the property of the client upon full payment.

6. Revisions and Corrections

ElmMac Pty Ltd is committed to client satisfaction and will make reasonable efforts to address concerns through revisions, bug fixes, corrections and technical adjustments, provided such requests fall within the agreed project scope. Requests outside the original scope may require additional fees.

7. Subscription and Maintenance Services

For recurring services such as website maintenance, software support, hosting management, SEO, digital marketing and technical support retainers, payments already processed for the current billing period are non-refundable. Clients may cancel future recurring services by providing written notice before the next billing cycle.

8. Chargebacks and Payment Disputes

Clients agree to contact ElmMac Pty Ltd first to resolve any concerns before initiating a chargeback or payment dispute. Initiating fraudulent or unjustified chargebacks may result in:

  • Immediate suspension of services;
  • Termination of contracts; and
  • Recovery proceedings for completed work and associated costs.

9. Intellectual Property

Where a refund is granted, ElmMac Pty Ltd retains all ownership rights to any work completed up to the refund date unless otherwise agreed in writing. The client may not use, publish, distribute, modify or deploy any partially completed work for which full payment has not been received.

10. Refund Request Procedure

All refund requests must be submitted in writing and include:

  • Full name;
  • Company name (if applicable);
  • Project reference;
  • Date of payment;
  • Reason for refund request; and
  • Supporting documentation where applicable.

11. Policy Changes

ElmMac Pty Ltd reserves the right to amend this Refund Policy at any time without prior notice. The version published on our website shall be the governing version.
